Terms & Conditions
Intention
59th Australian Latvian Arts Festival Pty Ltd ACN 660 287 767 (“AL59KD”) is hosting an art exhibition with the theme “Visi Kopā, Zem Vienas Saules” (in English: Everyone Together, Under One Sun). The following terms and conditions apply to any person wanting to submit a work to be exhibited.
Eligibility

The exhibition is open to entries from anyone, except AL59KD committee members.

If an entrant is under the age of 18 years on 31 December 2023, the parent or legal guardian of the entrant must consent, and agree to the exhibition terms.
Exhibition
-
Exhibition Works exhibited will be judged by a panel of judges.

There are two categories for the exhibition: Youth and Open.

The Youth category is open to persons under the age of 18 years on 31 December 2023.

The Open category is open to all persons .

In these exhibition terms, an entry may be 2D or 3D, audio, video, or other. The entrant must contact the organiser Lia Buchanan (lia.c.buchanan@gmail.com) if their artwork has special requirements for installation (including large size, fragile objects, special lighting requirements, and other) before submitting.
Exhibition entry applications

Applications for artwork entries for the exhibition should be submitted between 12 October 2023 and 1 December 2023.

AL59KD may, in its discretion, consider any artwork entry applications outside this period.

AL59KD may, in its discretion, change the dates for submission of entry applications, and publish such decisions as it sees fit.

An entrant may submit multiple entries. Each entry must be submitted separately.

An artwork may only be submitted in one category.

The entrant is responsible for any and all costs and expenses in respect of the production, clearing, submission, exhibition, and the delivery of the artwork.

The AUD$10 entry fee for the Open category and a AUD$5 entry fee for the Youth category, per artwork, must be paid before or at the time an entry application is submitted. Entry fees are to be transferred to: The 59th Australian Latvian Arts Festival Pty Ltd. (Account BSB 704-235, Account number 40015753), using your name as a reference.

All entries must be submitted in accordance with these exhibition terms. AL59KD may, in its discretion, accept entries that do not conform with the requirements set out in these exhibition terms.

If the artwork is larger than 1 metre by 1 metre or will need special installation requirements, the entrant is to contact the organizer, Lia Buchanan (lia.c.buchanan@gmail.com), before submitting an application to ensure that the organisers are able to exhibit the work.

Each application is to include an overview of the artwork of not more than 200 words, in Latvian and/or English;

Each application is to include a brief biography of the entrant, of not more than 100 words, in Latvian and/or English;
-
Each application is to include details of any restrictions applicable to the exhibition of the artwork (if any); Each application is to include details of any commercial sponsorship or endorsement of or to the artwork (if any).

The price of each artwork will be determined by the artist and not be the responsibility of AL59KD. Prices of the artworks are to be decided at the point of application for entry.
Artwork guidelines and delivery

The art exhibition’s theme is “Visi Kopā, Zem Vienas saules” (in English “Everyone Together, Under One Sun”). The artwork should embody this theme.

The artwork may use any language, including Latvian or English.

artworks need to be delivered to Melbourne Latvian House, 3 Dickens Street, Elwood, VIC, 3184, before 11. December 2023. If the artwork is to be delivered by post, it must be posted to: Lia Buchanan, C/- 3 Dickens Street, Elwood, VIC, 3184. If the artwork is to be sent electronically, it should be sent to lia.c.buchanan@gmail.com.
Other requirements

It is the sole responsibility of the entrant to:
-
secure all necessary permissions from any contributor to the artwork, and the rights holders of all and any copyright or trademark content or materials included, including necessary consents and waivers of all and any moral rights applicable to the artwork, to reproduce and exhibit the same;

ensure that all persons featured in the artwork have supplied their consent and to the use of their name, image and likeness in or in respect of the artwork, and to the public or private, theatrical or non-theatrical exhibition of the artwork;
-
ensure that the entrant has the right to use all and any music, and the recording of such music, used or embodied in the artwork for all purposes whatsoever associated with the artwork.

AL59KD will not be held responsible for any inclusion in the artwork of:
-
any copyright or trademark content or other materials or any other content that are, or may be, or become, the basis for any Third Party Claim, whatsoever;
-
any failure by the entrant to obtain all and any necessary licences, consents or rights necessary or desirable for the the public or private, theatrical or non-theatrical exhibition of the artwork, or the adaptation, use and reproduction of any of the artwork by AL59KD.

Artwork rights

The entrant warrants and represents to AL59KD that:
-
the artwork (including the whole making process, tools, equipment, and materials) is their own original work and creation, and that the artwork (including each and every part and parts) has not been copied from any other person (except where the entrant has obtained and holds the copyright or an appropriate licence in such other material), and that the use or reproduction of the artwork, including by way of public or private, theatrical or non-theatrical exhibition of the artwork by AL59KD, does not infringe the intellectual property or any other rights of any other person or entity;

the entrant holds all of the rights necessary to have fully and completely complied with each and every requirement of the entrant as particularised under “Other requirements”, above;
-
without limiting the generality of the above, the entrant warrants and represents that the artwork does not include any defamatory, offensive or unlawful content.

The entrant retains all copyright and other intellectual property rights in the artwork submitted as part of this exhibition. The entrant does, however, from the time of the entry grant to AL59KD a non-exclusive, royalty free, freely sublicenseable, perpetual licence to adapt or modify, or publicly display/perform by way of public or private, theatrical or non-theatrical exhibition of the artwork.

The entrant agrees and authorises AL59KD to use their name and images of their artworks in connection with the publicity for events in and at the 59th Australian Latvian Arts Festival relating to the artwork exhibition and the exhibition of the artwork and other artworks submitted to AL59KD.

The entrant, and the parent or legal guardian of the entrant (if applicable) hereby indemnify and agree to keep indemnified AL59KD from and against all and any claims and demands made against AL59KD or any of its officers, employees or volunteers, or any assignee or licensee of AL59KD, and any loss, cost or expense that they or any one or more of them may suffer, sustain or incur in relation to the warranties, representations and promises made by the entrant and the parent or legal guardian of the entrant (if applicable) in these exhibition terms.
Determination of winner and prize

The exhibition will be judged by a panel of judges selected by AL59KD. Their decisions (which will be final) will be announced by AL59KD when AL59KD determines.

Prizes for the categories are:
-
Open category: AUD$700 for 1st place; AUD$350 for 2nd place; and AUD$150 for 3rd place

Youth category: AUD$200 for 1st place, AUD$100 for 2nd place, AUD$50 for 3rd place

AL59KD may, in its discretion, obtain sponsors or endorsements for one or more of the Prizes, and attach naming rights to a Prize, and any fee or reward paid by the sponsor, or for these sponsorship or endorsement rights, is the property of AL59KD.
Other matters

AL59KD is not responsible for lost, late, misdirected, incomplete, illegible, or otherwise unusable entries

Proof of sending will not be considered proof of receipt.

Artworks may be sold throughout the exhibition. Sales made from the exhibition (including sales made after the exhibition has closed, but were made due to the exhibition) will incur a 30% commission. The entrant’s stated asking price will be exhibited alongside each artwork.

AL59KD reserves the right to cancel or modify the exhibition and award prizes by alternate means.

AL59KD reserves the right to alter these exhibition terms without notice. These terms are not confirmed to govern artwork exhibitions in any future Australian Latvian Arts Festival.

AL59KD is not liable for any loss, damage or injury caused to any artwork or entrant as a result of their entry into this exhibition, or for any lost opportunity or reputational or other loss or damage.

AL59KD may disqualify any entrants or decline to consider any artwork in the discretion of AL59KD, and need not give any reason for any such decision.

By submitting an entry, the entrant and the parent or legal guardian of the entrant (if applicable) acknowledges that they have read and understood the exhibition terms. Each entrant and the parent or legal guardian of the entrant (if applicable) accepts, and is deemed to have accepted these exhibition terms, and agrees to be bound by the exhibition terms by submitting an entry into the artwork exhibition.
